These Terms and Conditions (“Agreement”) outline the rules and guidelines for using the Modular Foundations website (“Website”) and any associated products or services (“Services”).

 

A legally binding contract between  the Parties comes into effect only once an order has been placed and the necessary deposit is paid.  By using our Website and ordering  goods and/or services from us, you are agreeing to abide by our terms and conditions  of sale.

1. Billing and Payment

All prices quoted are in Euro (€) unless otherwise stipulated. Errors and omissions excepted (E&OE).

 

All fees must be paid in full on or before the due date.

 

2. Third-Party Services

If you engage third-party services even those endorsed  by us you are bound by their rules and regulations and Modular Foundations will accept no responsibility for any failings that may arise on their part.

 

3. Variations and Amendments

Any changes to the design and specification of the product may not be possible once the final and agreed upon order has been placed. Every effort will be made to accommodate changes however this will not always be possible and may incur an additional charge.

 

4. Cancellations

We at Modular Foundations understand that people's financial situations can change suddenly and unexpectedly therefore a 72 hour cooling off period is allowed from once a deposit is paid for cancellation purposes. If cancellation is within those 72 hours no penalty will be charged and the deposit will be returned in full however if cancellation is sought after the cooling off period a fee of......will be deducted from the deposit before it is returned.

 

The cancellation of a special order product will incur the loss of the full deposit after the 72 hour cooling off period.

 

5. Limitation of Liability

By ordering you agree that it is your sole responsibility to confirm the Product is suitable for the purpose for which it is intended.

 

Modular Foundations accepts no responsibility for any changes made after installation has been completed by our team of experts. Any changes made are done so entirely at the purchasers own risk and no liability will be accepted by Modular Foundations.

 

If, for whatever reason, We or Our Suppliers are unable to fulfill your order we will refund you in full as soon as possible. Modular Foundations will be under no obligation to provide compensation in any form.

 

While every effort will be made to ensure delivery, construction and completion of the product within the agreed upon time frame, Modular Foundations will not be held liable for any delays outside of their control such as, but not limited to, serious illness, adverse weather conditions, strikes and/or acts of war.

 

6. Planning Permissions and Regulations

While We at Modular Foundations will endeavour to provide all assistance to You it is Your sole responsibility to ensure that this development meets with the planning regulations in your area. By placing an order with Us you are confirming that you have checked with your local authority and that You are abiding by their rules.  We at Modular Foundations cannot be held liable for any errors in judgment on Your part and any mistakes made in relation to planning permissions and regulations in your area.

 

7. Assignment

You may not transfer your rights or obligations under this Agreement without our prior written consent. We may transfer our rights or obligations without notice.

 

8. Changes to this Agreement

We may update Our Terms and Conditions at any time and without warning. By using Our Website you are agreeing to abide by any and all revisions.
